Is this man in the army illegally???

There is this guy in the army that didn't reveal a history of PDD-NOS when he joined. What happened was he was having trouble in school when he was in 3rd grade so he was never actually diagnosed with it but he had a chapter attached to a medical report so he could get accommodations in school. He carried those all the way through his first semester of college. While in college, he was told he couldn't contract even after he dropped the accommodations. When he got a diagnosis for $2000 saying he didn't have it, he still couldn't even go to DODMERB for fear that he may have it. He then dropped out of college and enlisted. When he enlisted, he didn't tell them anything about his medical history and got in. The recruiters knew he was in ROTC but he told them that he stopped taking it cause his grades fell apart. Because he was never contracted, they didn't have any records to see that he was thrown out for medical reasons. He got in and is doing ok but is he in the army illegally???????Is this man in the army illegally???
If he signed a contract that states he doesn't have anything wrong with him, and he knows full well he does then he is guilty of

Article 83 UCMJ -Fraudulent enlistment, appointment, or separation,

Art. 107 UCMJ making a False Official Statement and possibly...

Article 134 - 40 Public record: altering, concealing, removing, mutilating, obliterating, or destroying, for the $2000 "diagnosis" if it could be proved that he got it solely to gain enlistment or other military service.

I'd say report it to the Law Enforcement desk of the installation he's at or your local PD. I'd level Art 83 charges since there's not doubt he knew about it and used falsified documents to get in.

Before you said he had mild OCD. Which is it?



No, he shouldn't have lied, but if he is doing fine, then no harm,no foul.



If he does end up being discharged for a mental illness, though, the Army can deny him medical benefits, as it was pre-existing and withheld.Is this man in the army illegally???
honestly i bet no one knows what pdd nos is or what a contract and accomodations means? and dodmerb???? sooo maybe speak english??
