If he signed a contract that states he doesn't have anything wrong with him, and he knows full well he does then he is guilty of
Article 83 UCMJ -Fraudulent enlistment, appointment, or separation,
Art. 107 UCMJ making a False Official Statement and possibly...
Article 134 - 40 Public record: altering, concealing, removing, mutilating, obliterating, or destroying, for the $2000 "diagnosis" if it could be proved that he got it solely to gain enlistment or other military service.
I'd say report it to the Law Enforcement desk of the installation he's at or your local PD. I'd level Art 83 charges since there's not doubt he knew about it and used falsified documents to get in.
So how and why does this concern you??Is this man in the army illegally???
Most likely.
Before you said he had mild OCD. Which is it?
No, he shouldn't have lied, but if he is doing fine, then no harm,no foul.
If he does end up being discharged for a mental illness, though, the Army can deny him medical benefits, as it was pre-existing and withheld. Is this man in the army illegally???
